The same day that Engadget posted, without irony or reference to the Apple Watch, images of the new Samsung Gear S2, the U.S. Federal Circuit Court of Appeals in Washington rejected a Samsung request to overturn the landmark iPhone case that set U.S. Ground rules for patent and design infringement in the age of smart devices.

Samsung was backed in this particular request, originally filed in May, by Google, Facebook, EBay and others. They argued that the 2012 jury verdict and subsequent court rulings gave too much value to the devices’ designs and not enough to their underlying electronics.

Last stop, should Samsung et al. Decide to go there, is the U.S. Supreme Court.

Thanks to BGR’ s Brad Reed for making the comparison that Engadget didn’t.
